PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS SITE.

BLISSCARES is a 501(c)(3) nonprofit organization that partners with BLISS Health, Inc., to strive for equitable access to prevention and treatment for HIV, Hepatitis, and STDs, especially for uninsured and underinsured individuals throughout Florida.

By using this site, you signify your assent to these Terms and Conditions. If you do not agree to all of these Terms and Conditions, do not use this site, and navigate away to another page.  These Terms and Conditions cover all pages and areas of the site.  You will not be prompted to agree to these Terms and Conditions, and your use is sufficient to signify your consent.

BLISSCARES reserves the right to revise and update these Terms and Conditions at any time.  Your continued usage of the BLISSCARES website (the “Site,”) means you accept any future changes or updates.

The Site Does Not Provide Medical Advice

The contents of the Site, such as text, charts, images, and other content created by BLISSCARES or that BLISSCARES licenses or obtains from other sources, as well as any other information or material on the Site (collectively, “Content”) are for informational purposes only.  

Content on BLISS CARES’s site is not intended to be medical advice.  It does not constitute, and should not be treated as, the diagnosis or treatment of any illness, injury, disease, or condition.  You should always seek the advice of your own physician or other qualified health provider (nurse practitioner, physician assistant, therapist, etc.) with any questions you may have regarding a medical condition or any symptoms you may be experiencing.  

If you receive conflicting information from BLISSCARES from what you receive from your own treating provider, you should never disregard that provider’s advice in favor of what you read or see on BLISSCARES site.  

You should never delay seeking treatment because of something you read on the BLISSCARES website.  

If you are experiencing an urgent medical issue or a medical emergency, call your physician or 911 immediately. 

BLISSCARES and the opinions of its staff, others appearing as guests, or other users are expressing their own opinions to hypothetical situations.  Relying on any information you see on the Site is done solely at your own risk.

Minors

BLISSCARES is not intended or designed for use by children.  If you are under the age of 18, you should not use the Site except for academic research purposes.  

Content Use by Site Users

Content on the Site is protected by U.S., and where applicable, foreign copyright laws.  You are permitted to view the Content for your personal, noncommercial use.  If you reproduce or link to any Content you must include a copyright notice attributing ownership to BLISS CARES.  Please be advised, BLISSCARES may not be the copyright owner of all Content, and may license or sublicense content from the owner or copyright holder.  

Title to the Content remains with BLISSCARES and/or its licensors and sublicensors. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and other features are subject to change or termination without notice in the discretion of BLISS CARES.  

All rights not expressly granted herein are reserved to BLISSCARES and its licensors. 

If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

Limitation of Liability

The use of the BLISSCARES Site and the Content is at your own risk.

When using the BLISSCARES site, information will be transmitted over the internet which is beyond the direction and control of BLISSCARES and those entities which assist or support the site.  BLISSCARES assumes no liability arising out of related to the delay, failure, interruption, or corruption of any data or other information transmitted to you or another in connection with use of the BLISSCARES site.

The BLISSCARES site and all Content thereon are provided on an “as is, where-is” basis.

BLISS CARES, ITS LICENSORS, AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. 

Without limiting the foregoing, BLISS CARES, its licensors, and its suppliers make no representations or warranties about the following:

  1. The accuracy, reliability, completeness, currentness, or timeliness of the Content, software, links, or communications provided on or through the use of the BLISSCARES site.
  2. The satisfaction of any government regulations requiring disclosure of information on the practice of medicine or the healing arts, the prescription of legend drugs and controlled substances, any particular diagnostic test, or any medical/surgical procedure or treatment, or the compliance of any software tool with regard to the Content contained on the BLISSCARES site.

In no event shall BLISS CARES, its licensors, its suppliers, or any third parties mentioned on the BLISSCARES Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the BLISSCARES Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not BLISS CARES, its licensors, its suppliers, or any third parties mentioned on the BLISSCARES Site are advised of the possibility of such damages. 

BLISS CARES, its licensors, its suppliers, or any third parties mentioned on the BLISSCARES Site shall be liable only to the extent of actual damages incurred by you, not to exceed $1000 USD. 

BLISS CARES, its licensors, its suppliers, or any third parties mentioned on the BLISSCARES Site are not liable for any personal injury, including death, caused by your use or misuse of the Site, Content, or public areas. 

User Created Content

Any personal information you submit to BLISSCARES regarding your personal account details will be kept confidential.  However, any information which is forward facing (i.e. username, posts, etc.) will be publicly available on the site.

The BLISSCARES site may contain interactive areas that allow users to post or upload content and other information, including comments, images, questions, reviews, and other materials with which other users and BLISSCARES staff may interact.  You agree that you will not post, upload, or transmit any communications or content of any type to any public area of the site, or any of BLISSCARES’s social media platforms that infringe on, or violate, any rights of any party including copyright, trademark, patent, defamation, privacy, or otherwise).

By submitting information or content to any public area or social media platforms, you agree to comply with these Terms and Conditions and other applicable polices, including those of the social media platforms.  BLISSCARES reserves the right to remove any content from the site for any reason or no reason.  

Image, Video, and Audio Files Posted by Users

Any image, video, or audio file you post or link to on the BLISSCARES Site or a Social Media Platform must be your own personal property that you created yourself and that you have all rights to use thereof.   You may not, and shall be liable to indemnify BLISSCARES for any content which violates trademark, copyright, privacy, or any other rights of any other person.  Memes, photos or videos of celebrities, and cartoon or comic images are usually copyrighted by the owner and will be prohibited.

No HIPAA or Other Protections

BLISSCARES’ website is not a diagnostic tool or a place for medical advice.  BLISSCARES does not offer treatment or medical services of any kind through the Site.  To that end, the Site is not covered by HIPAA or any other patient protection laws of the United States or foreign jurisdictions.  Any personal medical information you post, or that may be solicited by another user, is not protected and shall be public immediately upon posting to the site.

To protect your privacy, you agree that you will not submit any media that contains personally identifiable information (like name, phone number, email address or web site URL) of you or of anyone else.  Uploading images or video of other people without their permission is strictly prohibited.

By uploading any media on the BLISSCARES Site or a Social Media Platform, you expressly warrant that you have permission from everyone appearing in that phot or video. 

Abusive Content

It is strictly prohibited to upload content of any kind that contain expressions of hate, abusive, or offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions.  BLISSCARES reserves the right to determine what is hateful, abusive, or offensive and to block or remove such content.  You expressly waive any right or cause of action related to the removal.

Grant of Right of Use

By uploading any media on the BLISSCARES Site or its social media pages: (a) you grant BLISSCARES a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully sublicensable right and license to use, copy, print, publicly display, reproduce, modify, publish, post, transmit, create derivative works from, and distribute the media and any material included in the media; (b) you certify that any person pictured in the submitted media (or, if a minor, his/her parent/legal guardian) authorizes BLISSCARES to use, copy, print, publicly display, reproduce, modify, publish, post, transmit, create derivative works from, and distribute the media and any material included in such media; and (c) you agree to indemnify BLISSCARES and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys’ fees, arising from the media and/or your failure to comply with these Terms and Conditions.

BLISSCARES reserves the right to review all media prior to submission to the site and to remove any media for any reason, at any time, without prior notice, at our sole discretion.

Passwords

In the event BLISSCARES employs one or more tools that allow you to record and store information,  you are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your BLISSCARES password (if any) or accounts. It is your sole responsibility to: (1) control the dissemination and use of sign-in name, screen name and passwords; (2) authorize, monitor, and control access to and use of your BLISSCARES account and password; (3) promptly inform BLISSCARES if you believe your account or password has been compromised or if there is any other reason you need to deactivate a password.

Content Requirements

If you use or post content on a public area of the BLISSCARES site or on any social media page, you are solely responsible for the content of such post or use of content, including the consequences of such post or use, and any consequences which arise from or are related to your reliance on any information found on the site or the BLISSCARES social media pages.

If you feel threatened or believe someone else is in danger, you should contact local law enforcement immediately. 

As consideration for your permission to use the BLISSCARES site and its affiliated social media pages, you agree that the following constitute a material breach of these Terms and Conditions:

  1. Using the site or a social media page for any purpose in violation of local, state, national, or international laws, or which violate the terms of service for such social media platform;
  2. Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
  3. Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by BLISSCARES in its sole discretion;
  4. Posting advertisements or solicitations of business;
  5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
  6. Posting chain letters or pyramid schemes;
  7. Impersonating another person;
  8. Distributing viruses or other harmful computer code;
  9. Harvesting, scraping or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments;
  10. Allowing any other person or entity to use your identification for posting or viewing comments
  11. Posting the same note more than once or “spamming”; or
  12. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the BLISSCARES or its social media pages, or which, in the judgment of BLISS CARES, exposes BLISSCARES or any one to any liability or detriment of any type.

BLISSCARES Reserves the Right (but is Not Obligated) to Do Any or All of the Following:

  1. Record the dialogue on the Site.
  2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
  3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with these Terms and Conditions.
  4. Terminate a user’s access to any or all the BLISSCARES Site upon any breach of these Terms and Conditions.
  5. Monitor, edit, or disclose any communication to law enforcement.
  6. Edit or delete any communication(s) posted on the BLISSCARES Site, regardless of whether such communication(s) violate these standards.

BLISSCARES or its licensors have no liability or responsibility to users of the BLISSCARES Site or any other person or entity for performance or nonperformance of the aforementioned activities.

Advertisements and Links to Other Sites

BLISSCARES may provide links to third-party web sites.  BLISSCARES does not recommend and does not endorse the content on any third-party websites. BLISSCARES is not responsible for the content of linked third-party sites, sites framed within the BLISSCARES Site, third-party sites provided as search results, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. BLISSCARES does not endorse any product, service, or treatment advertised on the BLISSCARES Site. 

Indemnity

You agree to defend, indemnify, and hold BLISS CARES, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from: (a) your use of the Site, (b) any content you post or upload, (c) your use of or reliance on any content, or (d) your violation of these Terms and Conditions.

Jurisdiction

You expressly agree that exclusive jurisdiction for any dispute with BLISS CARES, or in any way relating to your use of the BLISSCARES Site, resides in the courts in and for Orange County, Florida, and you further agree and consent to the jurisdiction of such courts, and the application of Florida law in connection with any dispute involving or related to BLISS CARES, the site, or any of its employee, agents, officers, directors, owners, shareholders, or affiliates.

Complete Agreement

Except as expressly provided in a particular “legal notice” on the BLISSCARES Site, these Terms and Conditions constitute the entire agreement between you and BLISSCARES with respect to the use of the BLISSCARES Site.
